These terms are the agreement between you and the publisher of KokoTrac.
By creating an account or using the app you accept them.
It is the same text in English and in Traditional Chinese; the English text is the reference.

1. Who publishes KokoTrac
KokoTrac is published and operated by SEAFOODHOLDHAND, Hong Kong Special Administrative Region ("we", "us", "our"). You can reach us at support@kokotrac.com. These terms apply to the KokoTrac mobile app and to the web pages we publish at kokotrac.com.
2. Who may use the app
You must be at least 18 years old to create an account. The app is made for parents and guardians. Children do not have accounts, and you may not create one on a child's behalf. You are responsible for the accuracy of the information you enter, for keeping your password safe, and for everything that happens through your account.
3. What the app is, and what it is not
KokoTrac is a personal record-keeping and planning tool for your family's extracurricular activities. It is not:
- a childcare, supervision or safeguarding service of any kind;
- educational, medical, legal, tax or financial advice;
- a payment processor for your activity providers.
Every schedule, cost, payment and balance shown in the app comes from information you entered. Check the figures against your providers' own invoices before you act on them. Reminders, calendars and notifications are conveniences that can fail or be delayed; you remain solely responsible for your children's attendance, safety and arrangements.
4. Your data
Your records live on your device and, when cloud backup is on, in a snapshot on our server. The Privacy Policy explains exactly what is stored and for how long. You are responsible for exporting a backup before deleting your account or uninstalling the app. The cloud snapshot is a best-effort convenience, not a guaranteed backup, and we are not liable for lost or corrupted records. You keep all rights to your data; you grant us only the limited licence needed to host the snapshot and run the service.
5. Acceptable use
You agree not to:
- use the app for any unlawful purpose;
- enter content you have no right to enter;
- attempt to access another person's account or data;
- scrape, overload, reverse engineer or interfere with the service, except to the extent permitted by applicable law;
- misrepresent your identity;
- resell or commercially exploit the app without our written consent.
We may suspend accounts that break these rules.
6. Third-party providers and affiliate links
The app shows clearly labelled sponsored recommendations (for example Preply, AmazingTalker and Outschool) and may link to other websites. We do not operate, vet or endorse any activity provider. Any class, subscription or payment you arrange with a provider is solely between you and that provider, under that provider's own terms. We may earn a commission when you sign up through a link, at no extra cost to you.
7. Paid features
KokoTrac is currently free. If we introduce paid tiers or subscriptions, they will be sold through the Apple App Store or Google Play, and those stores' terms, prices and refund policies will apply to the purchase. Unless a store's rules require otherwise, subscriptions renew automatically until cancelled in your store account.
8. Changes to the service
We may add, change, suspend or remove any feature, or stop the whole service, at any time and without notice. Because the app is free, we owe no compensation for any change, suspension or shutdown. Before a shutdown we will, where practicable, keep the service and the export function available long enough for you to take your data out.
9. Intellectual property
The app, its code, design, brand and site content are our property or licensed to us. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app for your family's own records. Everything you enter remains yours.
10. No warranties
The app is provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and that the service will be uninterrupted, error-free, secure or free of data loss.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or exemplary damages, including lost data, lost savings, lost profits or goodwill, even if advised of the possibility. Our total liability for all claims connected with the app is capped at the greater of (a) the amount you paid us in the 12 months before the claim, which may be zero, and (b) USD 10 (about HKD 80). Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer law.
12. Indemnity
You agree to compensate us for third-party claims, costs or damages arising from your use of the app, the content you enter, or your breach of these terms, except to the extent the claim is caused by us.
13. Ending the service or your account
You can stop using the app and delete your account at any time in Settings, which erases your data as described in the Privacy Policy. We may suspend or terminate an account for breach of these terms, for legal or security reasons, or, because the service is free, for any other reason. Sections 9 to 12 survive termination.
14. Disputes
Email support@kokotrac.com first; most problems are solved that way. If we cannot resolve a dispute within 30 days, it is governed by the law of Hong Kong SAR and decided exclusively by the courts of Hong Kong SAR. Nothing in these terms takes away consumer rights your local law grants mandatorily, and where such law gives you the right to bring proceedings in your own courts, that right is unaffected.
15. Changes to these terms
We publish changes on this page with a new date. Material changes are flagged in the app or on the site before they take effect. Continuing to use the app after a change takes effect means you accept the updated terms; if you do not, stop using the app and delete your account.

KokoTrac 由 SEAFOODHOLDHAND（香港特別行政區，下稱「我們」）發佈及營運，聯絡電郵 support@kokotrac.com。本條款適用於 KokoTrac 流動應用程式，以及我們發佈於 kokotrac.com 的網頁。
二、使用者資格
您須年滿 18 歲方可建立帳戶。本程式供家長及監護人使用，兒童不設帳戶，您亦不得以兒童名義建立帳戶。 您須對所輸入資料的準確性、密碼的妥善保管，以及透過您帳戶進行的一切操作負責。
三、程式的用途與限制
KokoTrac 是記錄及規劃家庭課外活動的個人工具。它並非：
- 任何形式的託管、看顧或兒童保護服務；
- 教育、醫療、法律、稅務或財務意見；
- 為活動供應商代收款項的支付工具。
程式內顯示的日程、費用、繳款與結餘，全部來自您輸入的資料，請在作出決定前與供應商的帳單核對。 提醒、日曆及通知僅屬便利功能，可能失效或延誤；孩子的出席、安全及各項安排，責任始終在您。
四、您的資料
您的紀錄儲存在您的裝置上；開啟雲端備份時，另有一份快照存於我們的伺服器。確切的儲存內容與期限 載於私隱政策。刪除帳戶或解除安裝程式前，請自行匯出備份。雲端快照屬盡力而為的 便利功能，並非有保證的備份；對於遺失或損毀的紀錄，我們不承擔責任。資料的權利屬於您；您僅授予我們 託管快照及營運服務所需的有限授權。
五、可接受的使用
您同意不會：
- 利用本程式從事任何違法行為；
- 輸入您無權輸入的內容；
- 嘗試存取他人的帳戶或資料；
- 在法律允許範圍以外抓取、超載、逆向工程或干擾本服務；
- 虛報身份；
- 未經我們書面同意轉售或商用本程式。
違反上述規則的帳戶，我們可予以暫停。
六、第三方供應商與聯盟連結
程式會顯示清楚標示的贊助推薦（例如 Preply、AmazingTalker、Outschool），並可能連結其他網站。 我們不營運、審查或背書任何活動供應商。您與供應商之間的課程、訂閱或付款安排，純屬您與該供應商之間的事， 受其自身條款約束。您經連結註冊時，我們可能賺取佣金，費用由供應商承擔，不會令您多付。
七、付費功能
KokoTrac 目前免費。若日後推出付費方案或訂閱，將經由 Apple App Store 或 Google Play 出售， 該商店的條款、價格及退款政策適用於該交易。除商店規則另有規定外，訂閱會自動續期，直至您在 商店帳戶中取消。
八、服務變更
我們可隨時新增、修改、暫停或移除任何功能，或終止整項服務，且毋須事先通知。由於本程式屬免費服務， 任何變更、暫停或終止均不獲任何補償。服務終止前，我們會在切實可行範圍內，保留服務及匯出功能足夠時間， 讓您取回資料。
九、知識產權
程式的代碼、設計、品牌及網站內容，屬我們所有或已獲授權使用。我們授予您個人、非專屬、不可轉讓且 可撤回的授權，供您為家庭自身紀錄使用本程式。您輸入的一切內容仍屬您所有。
十、不作出保證
本程式按「現狀」及「現有」提供，不附任何保證。在法律允許的最大範圍內，我們不作出任何默示保證， 包括適銷性、特定用途適用性、準確性、不侵權，以及服務不中斷、無錯誤、安全或不會遺失資料等保證。
十一、責任限制
在法律允許的最大範圍內，我們不對任何間接、附帶、特殊、相應或懲罰性損害負責，包括資料遺失、 損失節省、利潤或商譽損失，即使已被告知可能發生。我們就與程式相關的全部申索所負的總責任， 以以下兩者中較高者為限：(a) 申索前 12 個月內您向我們支付的款項（可能為零）；(b) 10 美元（約 80 港元）。 本條款不排除或限制法律不可排除的責任，包括因疏忽引致的死亡或人身傷害、欺詐，或強制性消費者法例下的責任。
十二、彌償
因您使用程式、輸入的內容或違反本條款而引起第三方申索、開支或損害，您同意向我們作出彌償； 但可歸咎於我們的部分除外。
十三、服務或帳戶的終止
您可隨時在設定中停止使用並刪除帳戶，資料會按私隱政策所述被清除。對於違反本條款或涉及法律、 安全風險的帳戶，我們可予以暫停或終止；由於本服務屬免費，我們亦可以任何其他理由終止。 第 9 至 12 條在終止後仍然有效。
十四、爭議
請先電郵 support@kokotrac.com，大部分問題均可循此解決。 若 30 日內無法解決，爭議受香港特別行政區法律管限，並由香港特別行政區法院專屬審理。本條款不會剝奪 您所在地法律強制授予的消費者權利；如該法律賦予您在當地法院提出法律程序的權利，該權利不受影響。
十五、條款變更
變更會在本頁公布並更新日期。重大變更會於生效前在程式或網站標示。變更生效後繼續使用程式， 即視為接受更新後的條款；如不同意，請停止使用並刪除帳戶。
